In the 2020 General Election, Kentuckians voted to add an amendment to the Constitution of Kentucky called Marsy's Law. This decision made Senate Bill 15 and Senate Bill 80 law. Senate Bill 15's amendments are reflected in Section 26A of the Constitution of Kentucky and Senate Bill 80 works in conjunction with KRS 421.500-421.575. Office of Victims Advocacy
The Office of Victims Advocacy (OVA) was formally established in 1985 to provide enhanced assistance to crime victims, as mandated by KRS 421.500, the Victims' Bill of Rights. The victim information guide is not to serve as legal advice, but rather, it is meant to serve as a guide to plainly explain the process and provide resources available.
Want to know what your rights are as a crime victim in Kentucky? The Office of the Attorney General is providing this handbook to you so that you can be educated on the role and responsibility of the local law enforcement, prosecutor, victim advocate, defense attorney, and Attorney General's Office.
The Crime Victims Compensation Fund Program is governed by the Kentucky Claims Commission.
The Kentucky Claims Commission decides crime victims’ compensation claims, hears and decides appeals on tax assessments, and hears and decides negligence claims filed against any Commonwealth of Kentucky state government agency.
In regards to the Crime Victims Compensation Fund Program, the Commission decides compensation claims from victims of violent crime who have no other resources to pay for the medical, funeral, mental health counseling, and dental or corrective lens expenses resulting from the crime. Assistance can also include lost wages of the victim or loss of support for someone dependent on the victim.
The Commission's goal is to provide not only the above-mentioned assistance, but also to show empathy to crime victims during a particularly traumatic time.
The Kentucky Victim Bill of Rights (KRS 421.500 to 421.575 ) provides crime victims with specific rights.
Included in those rights is the right to submit a victim impact statement after conviction, but prior to or at sentencing and to the parole board when the defendant becomes eligible for parole.
A victim impact statement (VIS) is a written statement from the victim which may contain, but need not be limited to, a description of the extent of the psychological, physical, and financial harm suffered by the victim, the victim’s need for restitution and whether the victim has applied for or received compensation for financial loss, and the victim’s recommendation for an appropriate sentence.
